Before I go into the 'what can be dones' a quick disclaimer....

I AM CURRENTLY ABOUT TO UNDERGO THIS PROCESS MYSELF BUT HAVE NOT YET SEEN IT THOUGH COMPLETELY, ALL COMMENTS THEREFORE ARE MY OWN PERSONAL OPINION AND I TAKE NO RESPONSIBILITY IF YOU DO DECIDE TO TAKE ON THE CRIMINAL BANKING  SYSTEM (although, if you do win the case I would be more than happy to receive your upvotes ! :)
So now you have a mortgage that is strangling you in it's 'Death Grip' and it is clear that this fraud has been schemed and carried out upon you.
What Now?First remember, the banks will not take any action set upon them lightly. Expect them to fight you with every dirty trick they've got in order to protect their turf and thus protect the scam and of course their lawyer and accountant cronies will be all too happy to obey. Be prepared for a long and hard battle but remember, you have truth on your side.
Step 1: Decide what you want to achieve, all your funds back plus the original note they fraudulently multiplied money with and you may also seek damages.
Step 2: We write a nice letter stating that you will pay any financial obligation you might lawfully owe as soon as you receive the following three documents.
1. Validation of the debt (the actual accounting).2. Verification of their claim against you (a sworn affidavit or even a signed invoice).3. A copy of the contract binding both parties.
You will also include in the letter that you believe you have been a victim of a fraud, forgery, false advertising, theft by deception, fraudulent conveyance, money laundering, wire fraud, extortion, blackmail and non disclosure and thus you are now offering to negotiate.
I sincerely believe that a renegotiation is required and therefore propose you send these documents first.
Under commercial law you have now offered renegotiation because these are the precepts. The bank of course will want immediate adjudication because they do not want to expose their scam so you should expect that they will want to proceed to a court judgement immediately and have you pronounced as being in default BUT since you have a right to ask questions, offer discussion and renegotiation in order to avoid conflict, which is dishonour, you have effectively cut off their game plan.
If they refuse and you give them 30 days to come back, then in effect they have already lost the case because they have refused to negotiate, talk about it and the court will now have to conclude that you have tried but that they refused. The court thus has no other option, they are in dishonour and not you. You have offered to negotiate and they have refused. Their refusal in effect proves that they have something to hide and that they are frauds.
Expect that the banks will not want this criminal behaviour to be exposed and will try all kinds of things to intimidate you and threaten you but remember, this is one more nail in their coffin, this again is extortion.

IMPORTANT I would suggest you do not just send a letter to the bank as you need confirmation that they have received it. It would be better to a notary public with it. He will give you a copy and then send the original to the bank. A notary is an officer of the court so this will give you further proof of your repeated attempts to negotiate and talk about the entire situation.

IN CONCLUSION Many people get scared, intimidated and flustered by the banks and don't know what to do and ultimately, giving up. Try to remember that in this case you are absolutely correct and they are wrong. You haven't done anything you have to be afraid of because you have discovered their scam and have offered to renegotiate in HONOUR.
