Documentary Review Making a Murderer P1 E7 Framing Defense
The trial continues and we're wondering why Lenk, Colborn and others from Manitowoc are roaming Avery's property. What part of recused do these creeps not understand? There are discrepancies regarding the sign in log, on the stand Lenk said he arrived around 1400, before the log was created, but when he was first asked months before he stated 1630ish, he never signed in. His sign out time? 2241. Remember, he also signed a transmittal slip for that vial of blood.
The blood inside that vial contained EDTA as a preservative, so if EDTA showed up in any of Avery's blood evidence you can be sure that blood was planted because we humans do not have EDTA in our bodies. Problem, there was no method to detect EDTA in blood. The FBI came up with one and had the results to the court one week before the prosecution rested their case. They detected none, which would indicate the evidence came from an active bleeder and not the tube.
But, for lab tests, just because you don't detect something doesn't mean it is not there. Every test has what is called an LOD, or Limit of Detection. Imagine cream in your cup of coffee. By looking at it you may or not be able to tell if it has cream if the amount of cream is too low. Let's say 10mL of cream is enough for your eyes to notice the change in color, but anything less than 10mL and you just can't tell. 10mL would be the LOD for your eyes regarding whether the coffee has cream in it or not in this example. The same with the EDTA in the blood. How much was in the vial to begin with? How much evaporated in the rav4? The amount tested was from swabs of the stains so the starting amount was very small to begin with. What is the LOD for the method the FBI used?
The defense expert stated she simply did not know what the detection limit of the method was from the lab report. She didn't say it was too high for the circumstances, she said she couldn't find a limit at all. Ask any analytical chemist and they will probably tell you they have never used a method without an LOD. All methods have these. Government labs dealing with evidence most certainly have these. This is a glaring omission for a government lab to make.
