The Inhuman Actions of CPS

You know how it is easy to lose your child and it is even easier if you are an emigrant. The CPS hunt for such helpless people who are protected by nobody and take away their kids. 

Violetta Ryabokon was born in Ukraine. In 2001 she, together with her mother and stepfather, came from the Donetsk region to Russia. All these years Violetta lived in Russia without any documents, except for the birth certificate. On the 12-th of September in 2016, 19-year-old Violetta gave birth to a daughter Eleonora. But the doctors told Violetta that they were going to leave the baby in the hospital!  They explained - it is so prescribed by law if the mother does not have a passport and her identity is not established.

Violetta tells: "I can not give my daughter to anyone. I really wanted a child, I was waiting for her very much. When the pediatrician said that my daughter would not be given to me, I got hysterical. The doctor called a psychologist. She began to convince me that it would be better for the daughter to stay in the hospital now. The psychologist said that I could get Eleanor only if I retrieved the documents. But I know that my problem with documents can not be solved, I've tried many times."

Violetta graduated from the correctional secondary school in the village of Romanovo, Sverdlovsk region in Russia, despite the lack of registration and other documents. The school acted correctly - the federal law "On Education" clearly states: you can not accept a child to school only in one case - if there are no places in an educational institution. Violetta`s teacher Natalia Systerova was outraged by the situation in which her former pupil got: "We tried to solve Violetta's problem with documents, but to no avail. Then the former student moved to another village, happily wrote to me that she was expecting a baby. Violetta is very kind, sympathetic and hardworking. A bit frivolous because of the young age. It is not right to take away her daughter. It is unfair, but we are accustomed to injustice."

When Violetta turned 14, she went to the local police station to get a Russian passport. Violetta was told that she was a Ukrainian citizen, so she would not get a Russian passport. The girl was advised to apply to the migration service.

Violetta`s mother has six underage children. The youngest is three years old. The woman explains: "The representatives of CPS say that if we want to get the child, we should start a documentation process. They say, we should go to the embassy of Ukraine in Yekaterinburg (a Russian city) or better at once to Ukraine - to apply for a Ukrainian passport. How do they imagine this? How will the daughter cross the border without documents? In addition, now I do not have the opportunity to buy a ticket to Ukraine. I don`t have money even to get to Ekaterinburg. We need to buy tickets and spend a night in the city. We can not manage in one day. I work as a nurse, the family is big, we only have enough money for the most basic things. Officials advise me to borrow money. But there is noone we can borrow the money.  All the savings I spent on preparing for the birth of my granddaughter. I recently left my husband because he drank, beat me and offended the children. But the CPS decided to restrict both of us of parental rights. I began to fight for my children. We moved from another village to the village of Sosva, away from the former husband. I am trying my best for the children. My ex-husband took away the card where the children`s allowance was transferred. He withdraws money from it. But I made repairs before birth, I bought a cot and a stroller for my granddaughter. I have seven children. I have to pay for everything- for school and kindergarten. I have a Ukrainian passport, I got permission for temporary residence, and Violetta was always with me. I understand that now Violet must be legalized in Russia, but the CPS should not blackmail us with the child. The daughter is in a panic, and the representatives of CPS are even not trying to understand our situation and offer us help."

But the girl was lucky. The organization "All-Russian Parental Resistance" threatened to appeal to the prosecutor's office with a request to verify the statements of officials.

Igor Morokov, the Commissioner for Children in the Sverdlovsk region, told that there was no reason not to give the child to the mother: "The CPS have no right to take the daughter from Violetta, despite her problems with the documents. The law protects the mother's right to be with her child. The state can take the child only if there is an immediate threat to his life and health. Otherwise, it will be a violation of the Family Code of the Russian Federation and the UN Convention on the Rights of the Child.

The recommendation of officials to go to Ukraine and apply for a Ukrainian passport is also absolutely typical and incorrect. Officials do this way for their own convenience. I can advise Violetta to apply for identification to the district police station. Unfortunately, this is a very long procedure. It will take least one month, if you deal only with this issue. But, if Violetta is recognized as a stateless person, she will be able to apply for Russian citizenship and a Russian passport."

I agree that it is not right that Violetta did not have any documents on the territory of a foreign country. But it is ridiculous to take a child because of it.  The CPS, instead of helping the family in a difficult life situation, act as a punitive tool. The state refers to refugees and migrants inhumanely. But it is especially scary, when such a cruel attitude affects children.

The similar situation occurred in Russia a few years ago. A Tajik citizen, Zarina Yunusova, was detained for violating migration legislation in St. Petesburg. Yunusova`s baby was taken away by the CPS from the police station. Umarali was placed in the center of medical and social rehabilitation of children left without parental care. At night the child died. Soon, Zarina Yunusova was expelled from Russia. In April 2016, the court found illegal the actions of the investigation into the death of Umarali Nazarov. But it is too late - the child can`t be got back.
